五部门发文征求意见 完善农民工工资保证金制度 连续3年未拖欠可免缴 欠薪纳入失信黑名单的加倍

    每到(dao)年终(zhong),农(nong)民(min)工(gong)(gong)(gong)(gong)欠薪问题都会成(cheng)为焦点。为预防和解决(jue)这一(yi)(yi)问题、进一(yi)(yi)步(bu)完(wan)(wan)善农(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)资保(bao)证(zheng)金(jin)(以下简(jian)称“工(gong)(gong)(gong)(gong)资保(bao)证(zheng)金(jin)”)制度,人(ren)力资源(yuan)社会保(bao)障(zhang)部(bu)牵头住(zhu)房城乡建(jian)设(she)(she)部(bu)、交通运(yun)输部(bu)、水(shui)(shui)利部(bu)、人(ren)民(min)银行(xing)日(ri)前出台(tai)了《关于进一(yi)(yi)步(bu)完(wan)(wan)善工(gong)(gong)(gong)(gong)程建(jian)设(she)(she)领域农(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)资保(bao)证(zheng)金(jin)制度的意见(jian)(公开征(zheng)求意见(jian)稿)》(以下简(jian)称《意见(jian)》),明确提出在建(jian)筑(zhu)市政、交通、水(shui)(shui)利等(deng)工(gong)(gong)(gong)(gong)程建(jian)设(she)(she)领域全面实(shi)行(xing)工(gong)(gong)(gong)(gong)资保(bao)证(zheng)金(jin)制度,实(shi)现所有在建(jian)工(gong)(gong)(gong)(gong)程项目全覆盖。

  根(gen)据《意见(jian)》,工(gong)资保证(zheng)金按(an)项(xiang)目(mu)(mu)所在地实行属地化管理,原则上(shang)由工(gong)程(cheng)(cheng)建设项(xiang)目(mu)(mu)的(de)施工(gong)总承包(bao)企(qi)业(包(bao)括直接(jie)承包(bao)建设单(dan)位发(fa)包(bao)工(gong)程(cheng)(cheng)的(de)专业承包(bao)企(qi)业)缴(jiao)存(cun)。缴(jiao)存(cun)标准为:按(an)工(gong)程(cheng)(cheng)建设项(xiang)目(mu)(mu)合同造价(jia)的(de)一定比(bi)例缴(jiao)存(cun),原则上(shang)不低(di)于造价(jia)的(de)1.5%,不超过3%。

  《意(yi)见》同时针对企业有无(wu)发(fa)生(sheng)拖(tuo)欠情况作出了具体规定:对缴存企业连(lian)续2年未发(fa)生(sheng)拖(tuo)欠工(gong)资(zi)行(xing)(xing)为的(de),可降低缴存比例(li),降幅(fu)(fu)不(bu)低于50%;对连(lian)续3年未发(fa)生(sheng)拖(tuo)欠工(gong)资(zi)行(xing)(xing)为的(de),可免于缴存工(gong)资(zi)保证金(jin)。对缴存前2年内发(fa)生(sheng)过拖(tuo)欠工(gong)资(zi)行(xing)(xing)为的(de),工(gong)资(zi)保证金(jin)缴存比例(li)适当提高(gao),增幅(fu)(fu)不(bu)低于50%;对因(yin)欠薪被纳入失信黑名(ming)单的(de),增幅(fu)(fu)不(bu)低于100%,其提高(gao)比例(li)后的(de)缴存金(jin)额(e)不(bu)受缴存金(jin)额(e)上限限制(zhi)。这意(yi)味着,一(yi)旦失信,代价(jia)将是“天价(jia)”。

  《意(yi)见》还规定:缴(jiao)存企业在(zai)同(tong)(tong)(tong)(tong)一省级行(xing)政(zheng)区(qu)(qu)域内有多个(ge)在(zai)建(jian)工(gong)程(cheng)项(xiang)目,或单(dan)个(ge)工(gong)程(cheng)项(xiang)目合同(tong)(tong)(tong)(tong)造价较(jiao)高的(de),应适当降低缴(jiao)存比例或设置缴(jiao)存金(jin)额上(shang)限。其中,在(zai)同(tong)(tong)(tong)(tong)一工(gong)资(zi)保证(zheng)金(jin)属地管(guan)辖区(qu)(qu)域(设区(qu)(qu)的(de)市),缴(jiao)存金(jin)额上(shang)限原则上(shang)不得(de)超过500万元。对同(tong)(tong)(tong)(tong)一工(gong)程(cheng)建(jian)设项(xiang)目,工(gong)资(zi)保证(zheng)金(jin)监(jian)管(guan)部门不得(de)要求企业重(zhong)复缴(jiao)存工(gong)资(zi)保证(zheng)金(jin)。

  缴存(cun)企业(ye)选择银行保函(han)或业(ye)主(zhu)担(dan)保等第(di)三方(fang)担(dan)保的(de)(de)方(fang)式替代缴存(cun)工资(zi)保证(zheng)金(jin)的(de)(de),工资(zi)保证(zheng)金(jin)监管(guan)部门不得(de)拒绝。有条件的(de)(de)地区要积极探(tan)索引入商业(ye)保险(xian)机制(zhi)。

  工资(zi)(zi)保(bao)(bao)证金(jin)(jin)监(jian)管部(bu)门要督(du)(du)促企业按规(gui)定(ding)及时足额缴(jiao)存工资(zi)(zi)保(bao)(bao)证金(jin)(jin)或提供相应(ying)第三(san)方担保(bao)(bao)。有关行业主管部(bu)门应(ying)向工资(zi)(zi)保(bao)(bao)证金(jin)(jin)监(jian)管部(bu)门定(ding)期通报新建工程项目(mu)信息,督(du)(du)促缴(jiao)存企业按规(gui)定(ding)缴(jiao)存,确保(bao)(bao)应(ying)缴(jiao)尽缴(jiao)。

  要(yao)规(gui)范工(gong)(gong)资保(bao)证金(jin)动(dong)用程序。施工(gong)(gong)企(qi)业拖欠工(gong)(gong)资被(bei)(bei)责令限(xian)期支(zhi)付(fu)逾期未支(zhi)付(fu)的,由人(ren)力(li)资源社会保(bao)障(zhang)部(bu)(bu)(bu)门或有关(guan)行业主管部(bu)(bu)(bu)门申请,工(gong)(gong)资保(bao)证金(jin)监(jian)管部(bu)(bu)(bu)门批准,可以(yi)动(dong)用工(gong)(gong)资保(bao)证金(jin)支(zhi)付(fu)被(bei)(bei)拖欠工(gong)(gong)资。资金(jin)动(dong)用后,工(gong)(gong)资保(bao)证金(jin)监(jian)管部(bu)(bu)(bu)门要(yao)督促缴存企(qi)业限(xian)期补(bu)足(zu)工(gong)(gong)资保(bao)证金(jin)。

  工程项目完工并(bing)经验收后(hou),未发现拖欠工资的(de),经缴(jiao)存(cun)企业(ye)申请并(bing)公示(shi),工资保证(zheng)金监管(guan)部(bu)门自公示(shi)期满之(zhi)日起(qi)5个工作日内,作出(chu)同意(yi)缴(jiao)存(cun)企业(ye)将工资保证(zheng)金本息(xi)一并(bing)转(zhuan)入该企业(ye)其他(ta)同名银(yin)行结算账户的(de)决定。

  工(gong)(gong)资(zi)保证(zheng)金由缴存企(qi)业(ye)存入工(gong)(gong)资(zi)保证(zheng)金专(zhuan)(zhuan)用账户(hu),实行(xing)专(zhuan)(zhuan)户(hu)管理。工(gong)(gong)资(zi)保证(zheng)金监管部门要建(jian)立(li)工(gong)(gong)资(zi)保证(zheng)金管理台账,严格(ge)规范(fan)财务、审计制度,加强账户(hu)监管,确保专(zhuan)(zhuan)款专(zhuan)(zhuan)用,防止挪(nuo)作他用。对擅(shan)自减(jian)免、超(chao)限额(e)收缴、违规挪(nuo)用、无故拖延(yan)返还(hai)工(gong)(gong)资(zi)保证(zheng)金的,要严肃(su)追究(jiu)责任,依法依规对有(you)关责任人员实行(xing)问责。
